The DeKalb County courthouse was built in 1967 on the square in Decatur, Georgia. The first floor houses the probate court, the second floor houses the state court, and the ground floor houses the Clerk of the Superior Court. The District Attorney, Prosecutor, and Criminal Magistrate Court are also housed in the DeKalb County Courthouse. An annex, the Camp Circle Courthouse Complex, houses the State Court Division B judges, who handle traffic issues.

DeKalb County Clerk of Superior Court

The DeKalb County Clerk of Superior Court manages all Superior Court and land records for the county. The Clerk is responsible for civil, criminal, and domestic records from cases heard in the Superior Court, as well as case filings, record-keeping, jury management, and responding to court records requests.

The current Clerk of Superior Court is Debra DeBerry. The Clerk’s office is divided into a number of departments, including Adoptions, Appeals, Notary, Criminal Division, Civil and Family Division, Property Fraud, Public Notices, Press Releases, LLP/General Partnerships, Records Requests, Passports, and Board of Equalization.

District Court

DeKalb County is in the jurisdiction of the United States District Court for the Northern District of Georgia. It is a federal trial court that hears civil and criminal cases within the Northern District, which includes the Atlanta metro area and surrounding counties. This court hears cases that involve civil rights, employment discrimination, environmental law, intellectual property, and federal criminal cases.

District Court judges are appointed by the President of the United States and confirmed by the Senate. They serve lifetime appointments. Timothy C. Batter, Sr. is the Chief Judge of the Northern District and Kevin P. Weimer is the Discourt Court Executive/Clerk of Court.

The Northern District is divided into several divisions. The Atlanta Division covers DeKalb County, as well as Cherokee, Clayton, Cobb, Douglas, Fulton, Gwinnett, Henry, and Rockdale Counties.

Superior Court

The Dekalb County Superior Court is a trial court with general jurisdiction. It has authority over felony cases prosecuted by the District Attorney’s office regarding land titles, equality, habeas corpus, mandamus, prohibition, adoptions, declaratory judgements, and other issues. It handles cases involving serious crimes (felony), civil disputes, real estate matters, and family and domestic issues. It is authorized to correct errors made by lower courts and, in some cases, has the right to direct review.

The Dekalb County Superior Court maintains a Family Law Information Center. The Center’s resources are available to any resident of Georgia and consultations with an attorney are available to DeKalb County residents and those filing a case within the county. Most services are free of charge.

Civil Court

In DeKalb County, the State Court handles civil cases not within the jurisdiction of the Superior Court and the Magistrate Court hears civil cases involving claims of $15,000 or less.

Magistrate courts are the court of first resort for many civil disputes, such as ordinance violations, dispossessories, landlord/tenant cases, and bad checks. The court does not hold jury trials and civil cases are often argued by the parties themselves. The Chief Magistrate in DeKalb County is Berryl A. Anderson.

The State Court has broader jurisdiction for civil claims and hears more significant legal disputes that are beyond the scope of the Magistrate Court. This may include, contract, personal injury, and property disputes, as well as family law matters. The Chief Judge of the State Court is Asha Jackson.

Drug Court

The Superior Court operates the DeKalb County Drug Court that engages non-violent offenders who struggle to stay sober. The Court is a two-year alternative sentencing program that involves judicially-supervised drug treatment. The Drug Court targets those that are high-needs or at a high-risk for recidivism. It offers two levels of treatment and supervision based on participant’s risk and service needs.

The program involves a number of offices and organizations beyond the DeKalb Superior Court, including: District Attorney’s Office, Police Department, Pretrial Services, Public Defenders Office, Sheriff’s Department, and DeKalb Community Service Board. The Drug Court also partners with many local universities and colleges, nonprofits, civic groups, and churches.
